Chhattisgarh HC grants interim bail to liquor scam ‘kingpin’

Businessman Anwar Dhebar, alleged to be the kingpin in the Rs 2,161-crore liquor scam, was granted bail on Monday by Chhattisgarh High Court on health grounds. Dhebar, 51, has been behind bars since May 6 after he was arrested by Directorate of Enforcement (ED) officials who alleged he led a syndicate that executed the scam. The final bail hearing will be held after three weeks.
The ED filed a prosecution complaint in a Prevention of Money Laundering Act (PMLA) court earlier this month against him, Indian Telecommunication Services official Arunpati Tripathi ,55, businessman Trilok Dhillon ,59, and their aides Nitesh and Purohit Arvind Singh.
Dhebar is the elder brother of Aijaz Dhebar who is Mayor of Raipur city and a Congress leader. Dhebar was represented by a battery of eight lawyers who applied for interim bail before the High Court on multiple grounds including health issues. One of the lawyers, Puneet Bali argued that his client Dhebar was suffering from various ailments relating to kidney failure and submitted relevant documents to support his claims. Bali also cited a recent Supreme Court judgment where the SC said that no coercive action must be taken and concerned respondent authorities i.e., the ED, “must stay their hands in all manner, therefore, if protection has been enlarged to certain other accused, then the present applicant (Dhebar), who is behind the bars also deserves the same.”
High Court Judge, Deepak Kumar Tiwari, while granting ad-interim bail noted: “In view of the aforesaid submissions, purely as an interim measure, this Court thinks it appropriate to release the applicant on ad-interim bail.” The order states that Dhebar needs to furnish a personal bond of Rs 5 lakh with two equivalent sureties of Rs. 5 lakh each to the satisfaction of the trial court or chief judicial magistrate or remand magistrate.
